      non-refundable.&nbsp; In addition, during the term of the Lease, =

      Fitzgeralds timely paid rent of $1,850.00 per month for every =
month of the=20

      daughter, Robbie Gail Charette, who assisted her parents in =
managing the=20
      Rental Property, sent an e-mail to the Fitzgeralds acknowledging =
the=20
      timely notice of termination.&nbsp; In this May 25, 2004 e-mail, =
Robbie=20
      Charette urged the Fitzgeralds to reconsider.&nbsp; The =
Fitzgeralds,=20
      however, did not change their minds and, on June 14, 2004, they =
gave=20
      written notice to the Charettes of their forwarding address.&nbsp; =
The=20
      Charettes immediately began seeking new tenants for the Rental =
Property.=20
      </SPAN></P></DIV><SPAN=20
      style=3D"FONT-SIZE: 13pt; LINE-HEIGHT: 150%; FONT-FAMILY: =

      tenants.&nbsp; To accommodate the Charettes in their plans, on =
June 29,=20
      2004, the Fitzgeralds agreed to move the remainder of their =
personal=20
